Terms of service
Customer – an individual who places orders in the online store www.latvijasperles.lv and is the recipient of the ordered goods. The goods purchased in the online store are used by the customer for personal use, for the needs of their family members or relatives, or for other purposes.

Parties – the Customer and the Seller
Online Store – the website www.latvijasperles.lv, where the Seller offers products for purchase, along with payment and delivery terms.
Website – www.latvijasperles.lv
Product – a tangible item available for sale on the Website.
Order – a properly completed request by the Customer for the delivery of selected Products to the address specified on the Website.
Delivery Service – a third-party delivery partner authorized by the Seller to provide shipping services to the Customer.
External Website – any third-party website linked from www.latvijasperles.lv
GENERAL TERMS
Unless a separate agreement has been concluded between the Customer and the Seller (hereinafter – the Parties), these Terms of Purchase and Sale (hereinafter – the Terms) constitute a legal agreement between the Customer and the Seller. They define the conditions for purchasing, payment, delivery, and return of goods, as well as other provisions related to the purchase of products or gift cards via the online store (hereinafter – the Purchase Agreement). By registering on the Website, the Customer confirms that they have read, understood, and agreed to all conditions outlined in these Terms. All information published on the Website (e.g. product descriptions, specifications, photos) is for general reference only and is not considered exhaustive.
SIA Latvijas Pērles reserves the right to make changes to product descriptions without prior notice.
1. REGISTRATION
1.1 Only the following individuals or entities may register, place orders, and purchase products on www.latvijasperles.lv:
1.1.1 A legally capable natural person who has reached the age of majority and is not restricted by court order;
1.1.2 A minor aged 14 to 18 with parental or guardian permission, unless using their own income;
1.1.3 A legal entity;
1.1.4 Authorized representatives of the above.
1.2 Product descriptions, specifications, and prices are only accessible to registered users.
1.3 The Seller is not responsible for the accuracy or reliability of the information entered by the Customer during registration.
1.4 The Customer agrees not to disclose their username and password submitted during registration.
2. PERSONAL DATA PROTECTION
2.1 By registering on the website and providing their personal data, the Customer agrees to receive informational messages, including important notifications related to payment and delivery, via the email address provided.
2.2 The Customer agrees that their email address may be used for direct marketing purposes.
2.3 The Customer must provide personal information (name, surname, delivery address, phone number, and email) as it is essential for completing the order, delivery, and payment process.
2.4 The Seller confirms that this data will be used only for delivery and direct marketing purposes.
2.5 The Seller commits not to disclose the Customer’s personal data to third parties, except to partners involved in product delivery or related order services. The Seller will store personal data in accordance with the laws and regulations of the Republic of Latvia. In all other cases, personal data may only be disclosed to third parties as provided by Latvian law.
3. PLACING AN ORDER
3.1 To place an order, the Customer selects the desired product(s) and proceeds to the shopping cart.
3.2 During checkout, the Customer must provide the following details:

3.3 After a successful order submission, the Customer will receive an email confirmation with the order status, indicating the current processing stage.
3.4 If the Customer orders a quantity exceeding available stock, the Seller will inform the Customer via the email provided during registration. The Customer may:

Pay for and receive the available quantity,

Cancel the unavailable items, or
-
Accept the Seller’s proposal to postpone the order until the full quantity is available.
If the Customer does not respond within 7 business days, the Seller reserves the right to cancel the order.
3.5 Product descriptions and visuals may not fully reflect actual characteristics (e.g. color tone, dimensions). Before placing an order, the Customer may contact the Seller for clarification. If no clarification is requested, the Customer is deemed to have accepted the product as described.
3.6 If a product is unavailable, including for reasons beyond the Seller’s control, the Seller has the right to cancel that item and will inform the Customer via email.
3.7 Latvijas Pērles is not responsible for any differences in product color due to the display settings of the Customer’s device.
3.8 By placing an order, the Customer confirms they have read and agree to all terms set by the Seller and to any conditions provided during checkout.
4. PRODUCT DELIVERY
4.1 The Customer may choose a delivery method when purchasing from www.latvijasperles.lv.
4.2 The Customer is responsible for providing a correct delivery address.
4.3 The Customer agrees to personally receive the order. If the Customer is unavailable but the order is delivered to the provided address, the Seller is not liable for delivery to an unintended recipient.
4.4 Delivery may be carried out by the Seller or an authorized representative.
4.5 Delivery costs depend on the delivery location, weight, and dimensions of the products.
4.6 The Seller reserves the right to adjust delivery fees.
4.7 Delivery time ranges from 2 business days up to 4 weeks. The specific delivery time is communicated to the Customer via email.
4.7.1 If the order contains products with different delivery times, the longest delivery time will apply.
4.8 Upon receiving the shipment, the Customer must inspect the contents together with the Seller or their representative and sign the invoice, delivery note, or another document to confirm the goods were received in good condition without visible damage.
4.9 If the packaging is damaged (e.g. torn, wet) or the product is incorrect or damaged, the Customer must note this on the delivery document and prepare a written damage report in the presence of the Seller or their representative. If this is not done, the Seller is not liable for the damage unless caused by a manufacturing or packing defect.
4.10 If the Customer notices that the product is incorrect in size, color, or type, they must immediately inform Latvijas Pērles.
4.11 The risk of accidental loss or damage transfers to the Customer once the order has been delivered.
4.12 If a product is lost by the courier, the Seller will refund the value of the item and shipping only after receiving an official loss confirmation or compensation from the delivery service.

4.14 Orders are delivered with an invoice, which also serves as a warranty document. The Customer is advised to verify their delivery address and contact details before finalizing the order.
5. PACKAGING, SHIPPING, AND PAYMENT TERMS
5.1 All products ordered by the Customer are packaged appropriately.
5.2 Payment can be made via internet banking through Swedbank, SEB, Citadele, Luminor-Nordea, or by bank transfer—an invoice for payment will be sent via email.
5.3 Delivery costs are calculated separately for each order. Please note that delivery costs are covered by the Customer.
5.4 The Seller retains ownership of the goods until full payment has been received.
5.5 Any additional costs related to the delivery of goods after dispatch are also the responsibility of the Customer.
5.6 Some products are custom-made by the manufacturer; therefore, delivery times may vary and can take up to 30 days.
6. DELIVERY METHODS
6.1 Available delivery options are listed on the website www.latvijasperles.lv.
6.2 Delivery methods include in-store pickup (free of charge) and Omniva parcel service within Latvia (€2.88). Orders outside Latvia are shipped via Omniva or national postal services.
6.2.1 All ordered products are delivered to Omniva’s central warehouse, from where the courier will deliver them to your specified address.
6.2.2 If the courier cannot deliver the package, it will be stored at Omniva's warehouse or parcel locker for 7 days.
6.2.3 Latvijas Pērles customer service representative will contact you via email, SMS, or phone to reschedule the delivery.
6.2.3.1 If the Customer fails to receive the shipment within the specified timeframe, it will be returned to the Seller.
6.2.3.2 The Seller reserves the right to request compensation from the Customer for shipping costs incurred.
6.2.3.3 The Customer must cover all shipping costs if the Seller officially sends a payment request.
6.2.3.4 The Seller reserves the right to deny future orders if such situations occur repeatedly.
6.3 Customers may also choose Latvian Post services.
6.4 Orders over €50 qualify for free shipping. The standard Omniva delivery fee is €2.88.
7. RETURNS
7.1 Product features are described on each product page. The Seller is not responsible for color differences due to the Customer’s display settings.
7.2 Items may be returned within 14 calendar days of delivery by submitting a written notice.
7.3 To return an item, email a request to info@latvijasperles.lv including the order number, product code, name, quantity, and reason for return (optional).
7.4 When returning items, the Customer must follow these guidelines:
7.4.1 The product should preferably be in its original packaging.
7.4.1.2 Carefully open the packaging upon receiving the product.
7.4.2 The Customer is liable for any use of the product that exceeds normal examination and causes diminished value. Returns must be submitted in writing.
7.4.3 The product must be returned in the same condition and with the same components as received. If components are missing or damaged, a deduction will be made from the refund amount.
7.4.5 A purchase receipt must be included with the return.
7.4.6 The Seller reserves the right to refuse returns that do not comply with return conditions.
7.4.7 Returns must follow the Seller’s procedure: items should be returned via Omniva to: Omniva, Shopping center "Dauga", Rīgas iela 23, Ogre, LV-5001.
7.4.8 Return shipping costs are the responsibility of the Customer.
7.4.9 Refunds will be issued to the original bank account within 3 business days after return approval.
7.5 Packaging for returned goods:
7.5.1 Preferably returned in a protective bag.
7.5.2 We recommend including original product tags, which serve as proof of purchase from www.latvijasperles.lv.
8. PRODUCT CATEGORIES NOT ELIGIBLE FOR RETURN OR EXCHANGE
8.1 Personal hygiene items with opened packaging (e.g., toothbrushes, electric shavers).
8.2 Audio or video recordings with opened packaging.
8.3 Items with custom-printed designs or personalized elements.
8.4 Underwear or socks if the packaging has been opened.
8.5 Items that, under the laws of the Republic of Latvia, are not eligible for return.
9. RETURN OR REPLACEMENT OF DEFECTIVE PRODUCTS
9.1 If a product is defective or a mistake has been made in the order (e.g., incorrect size or color), you may return or exchange the product for the correct one as indicated in the order.
9.2 The Seller will replace the defective item with a new one or carry out the necessary repair.
9.3 To report a defect, email info@latvijasperles.lv, including the product name, code, order number, a brief description of the defect, and your phone number or email address.
9.4 All defect claims are processed in accordance with Latvian law.
9.5 You will receive a response to your defect claim within 3 business days.
10. PRODUCT DEFECTS
10.1 The Customer may request a remedy in the following cases:

If a non-repairable defect prevents proper use of the product, the Customer may request a replacement or a full refund.

If the defect is repairable but occurs repeatedly, affecting usability, the Customer may request a replacement or a full refund.
10.2 The Customer must notify the Seller of the defect immediately after detection, but no later than the expiry of the product's warranty period.
10.3 The Seller will review the claim and respond within 30 days after receiving the defective product and the Customer's notice.
10.4 The decision regarding the claim will be communicated to the Customer by phone within the 30-day review period.
10.5 The Seller is not liable for product defects or damages in resale to third parties.
10.6 All warranty-related rights and obligations are governed by Latvian law.
11. WARRANTY EXCLUSIONS
The Customer loses the right to warranty services if:
11.1 They cannot provide proof of purchase or delivery.
11.2 Visible defects were not reported upon delivery.
11.3 The warranty period has expired.
11.4 Damage is caused by the Customer’s actions.
11.5 The product was used in unsuitable environments (e.g., high humidity, chemical or mechanical exposure).
11.6 The product was used for unintended purposes.
11.7 The product was used under extreme conditions or against instructions, technical standards, or safety regulations.
11.8 Damage occurred due to force majeure or unforeseeable circumstances.
11.9 Damage was caused by water, fire, or other uncontrollable factors.
12. WARRANTY CLAIM RESOLUTION OPTIONS
The Seller may resolve the claim by:
12.1 Repairing the defective product.
12.2 Replacing the product with a new one.
12.3 Refunding the full purchase price.
12.4 Providing a partial refund reflecting the reduced value.
12.5 Offering the Customer a choice between the above options.
12.6 Rightfully rejecting the warranty claim.
13. FINAL PROVISIONS
13.1 The Seller reserves the right to amend these Terms and related documents. Changes become effective once published on the website.
13.2 If the Customer disagrees with the updated Terms, they may discontinue use of the e-shop services.
13.3 Continued use of the e-shop implies acceptance of any amendments to the Terms.
13.4 These Terms are governed by the laws of the Republic of Latvia.
13.5 Any disputes will be resolved through negotiation. If no agreement is reached, disputes will be settled in accordance with the Latvian Civil Procedure Law.
13.6 The Parties are exempt from liability in the event of force majeure circumstances beyond their control.
